Then I met my lovely wife.

04/06/2006How to choose a weapon according to the law? As you know, ignorance of the law is no excuse. But knowing the law just helps to avoid legal problems. Therefore, let’s see how you can legally carry edged weapons and not fall under the existing legislation. First of all, you need to know what the law means by edged weapons. First: combat knives. Do not just think that this is something super-efficient and terrible. This, unfortunately, is just bureaucratic terminology. It is not clear by whom and why it was invented, but it interferes with life for many, especially the owners. By combat knives, our legislators mean all models of edged weapons that are in service with the army and many other law enforcement agencies. This term has nothing to do with combat properties. The only reason for this approach is most likely very prosaic: if there weren’t this ban on circulation in the civilian sphere, then combat knives would have stolen everything long ago, and so something else will remain. So, the bayonet-knife for the AK-74 assault rifle, popularly known as “the joy of a masochist” for its disgusting consumer qualities, cannot be bought and used. But you can buy a Ka-Bar knife, which is in service with the US Marine Corps. No problem: buy as a hunting weapon. And that’s true – he’s not in service with our army, why limit him. And the fact that the combat properties of the Ka-Bar are two heads higher than the bayonet-knife is already minor technical details. I think the Ka-Bar firm has already thanked our “wise” legislators more than once. And you can guess what words these bans accompany at our arms factories, which simply have nowhere to put these bayonet-knives. However, there are many such “miracles” in the law on weapons. Therefore, we will not rack our brains over military weapons, especially since the long-cherished illusion that the best was done for the army in the Soviet country is nothing more than an illusion. A combat knife for a multi-million army should not be good, but cheap. And cheap is not good. Now let’s deal with the most common type of melee weapons – civilian melee weapons. Until recently, all its varieties were lumped together and represented something generalized, denoted by the term – “hunting knife”, which was absolutely wrong. Now, finally, GOSTs have appeared, in which civilian edged weapons are divided into several positions. For example, there was a nomination for survival knives. There were requirements for hunting daggers and much more, up to long lengths like the Cossack saber. Of course, all this is not very interesting for a specific consumer, but GOST, along with the criteria for knives that are weapons, also establishes criteria by which a knife is not such. Therefore, if a survival knife is a weapon, then a knife for tourism is already a household item. A hunting knife is a weapon, but a special hunting knife is no longer recognized as such. This line between weapons and non-weapons greatly affects the consumer qualities of a knife. First of all, consumer qualities mean the possibility of its legal acquisition. So what do you need to do to buy it? If a knife is not a weapon, then buying one is not much different from buying bread at a bakery. Selected, paid and taken away for use. But if the knife fell into the category of civilian weapons, then that’s it – the holiday is over, bureaucratic everyday life has begun. First of all, since the knife is a hunting knife, then it is sold only to hunters. This means that you must have a firearms permit and a hunting license. Moreover, if hunting knives are sold according to these rules, then at least a grain of common sense can be found in this order. And why all these obstacles when buying a survival knife or a diving knife? He is something a normal hunter for free is not needed. But according to the law, only a hunter can buy it. Obvious nonsense. At the same time, this situation looks especially piquant against the background of opportunities for the purchase of firearms. You have the right to buy a hunting rifle for self-defense and not be a hunter, just have a permit from the Ministry of Internal Affairs. But to buy a knife, you definitely need a hunting license. Theoretically, getting it is a rather tedious procedure, which involves special studies, passing exams, and much more, for which a normal person, quite naturally, feels sorry for both time and effort. In practice, a hunting ticket, of course, is simply bought, so you can safely attribute the amount of bribes or contributions to the cash desk of a hunting society to the cost of a licensed hunting knife. Glory to corruption – it makes life much easier in our bureaucratized state! But the funny thing is that the need for this ticket is only because you need to enter the number of your knife somewhere. Moreover, if we take into account that according to the previous law on weapons, the registration of edged weapons was not required, and many people bought knives without any numbers, then the developers of the law at once brought these respectable citizens into criminals. There is no point in putting a number on it. You can engrave it “from the bulldozer” and add it to the hunting ticket. Naturally, it is not registered anywhere, is not listed anywhere and does not pass. Moreover, often, having one numbered knife, when buying the next one, they simply put an existing number on it. As a result, dozens of knives can be listed on one number. Of course, there is no sense in such an account and there cannot be. But, suppose, having passed all the obstacles, you became the owner of a numbered hunting knife. Many believe that if it is written on your hunting ticket, then this is almost an indulgence for wearing it. Yeah, now you forgot what country you live in. So you were allowed to walk the streets with weapons! Read the law on weapons: it says in black and white that carrying weapons is prohibited. And the police don’t care about your legal hunting license. You can only carry out transportation. But what transportation is and how to interpret the movement of your knife from point A to point B, no one knows, and no one can predict how the policeman you met will react to solving such a problem. Well, it’s not good to carry a hunting knife in the city, there is a certain reason. But here you are in the forest, for example, on a country picnic. Is it possible here? AN no, it’s not that simple. A knife is a hunting edged weapon. Being with a weapon in the forest without a permit, during the time when hunting is prohibited, is, excuse me, practically poaching. You will say that this is obvious nonsense, but what to do we live in a country where such legislation is in force. Besides, where does the law or the fight against crime or poaching have to do with it? Everything is much simpler: the police and rangers do not need you to comply with the law, they need a reason why you can cause maximum trouble and the opportunity to receive some monetary compensation so that trouble does not happen. That is, we have adopted laws that directly encourage the flourishing of corruption. Do not forget that a licensed knife is, by definition, more expensive than its non-registered counterpart. The reason is simple: there are strict requirements for the manufacture and trade of weapons. This includes an alarm system, a specially equipped weapons room, licenses, armed guards during transportation, plus various extortions and bribes. And everything is doubled: first, all these fees are paid by the manufacturer, and then by the seller. All this is an extra cost, all this is a feeding trough for specific officials and entire organizations. Therefore, if a knife is a weapon, then all this is automatically included in its cost. If you want to additionally feed the police and officials, buy a licensed knife. At the same time, its increased cost does not affect the quality of the knife for the better. As you can see, a hunting license knife is a continuous problem both when buying and when using it. You can’t even look at it properly in a gun shop. The seller will require you to have a hunting license and only if you have it will give you a knife in your hands. This is the reason why both users and manufacturers strive to have and make knives that are not related to melee weapons. So, for example, the Moscow company Yuzhny Krest, known for its hunting knives, decided to radically update its assortment, adding military-style knives and survival knives to it. As a result, a series of so-called “expedition knives” appeared. At the same time, having no experience in designing such products, the Southern Cross simply copied samples of the well-known American firms Cold Steel and Ka-Bar. As a result, what happened turned out to be 100% melee weapons. The knives aroused interest, they were actively examined, twisted in their hands, but the trouble is that they were bought poorly. The reason is that they are melee weapons, and no one needs problems with a hunting license and registration. Buyers have wised up, but manufacturers have not. As a result, the company had to make an unprecedented decision: cut the guards on the knives and fit them to the requirements of GOST for tourist knives. But in such a castrated form, the knives simply lost their presentation, and the interest of buyers in them quickly disappeared. Well, what you don’t need to buy, he explained, it remains to tell, but what is still possible. Shop counters are literally littered with knives. And most of these knives are not weapons, but household items. There are many criteria for declaring a knife as a weapon. For example, you can have a knife with a blade length of up to 150 mm, a blade thickness of not more than 2.4 mm, with a developed guard that provides a reliable stop. Blade sharpening is one and a half or with various saws on the butt. This will apply to tourist knives. The limiting criterion is the thickness of the blade, due to which the blade does not have the necessary rigidity when stabbing. But the same tourist knives, for example, include the Bivak knife-cleaver, although its blade thickness is 6 mm and the blade length is 200 mm. And yes, there is a guard too. How does it work? It’s simple – at “Bivak” the shape of the front of the blade is such that it is not designed for a stabbing blow. As you can see – a lot of nuances. As a result, you can freely buy and use a quite decent knife without breaking your head over the legal aspects. Or, for example, Finnish-type knives, for example, the Finnish “Smersh”. Blade length up to 150 mm, thickness, depending on the modification, or 4 mm, or b mm. Sold freely. The reason is the lack of a guard. Although the shape of the handle allows you to securely hold such a knife in any situation. It’s getting ridiculous: the army structures are already interested in knives that are not melee weapons. Indeed, in a real war, a person has no time to think about the fate of a piece of state-owned iron. And if lost or broken, then problems begin. It’s a melee weapon! Therefore, many military personnel buy the same Smershi with their own money and actively use them in combat operations. An excellent illustration of the question of the criteria for a combat and non-combat knife and the reasonableness of the law on weapons. Or, for example, cutting hunting knives. Here the knife can have all the parameters of melee weapons, with the exception of the shape of the blade. For example, the sharp tip is 5-6 mm above the handle line. It is difficult to deliver a stabbing blow with such a blade, it will simply slip off, and according to this criterion, the knife is not considered a weapon. Manufacturers are well aware of the benefits that the production of knives in household attire brings, so the variety of types and models allows the consumer to choose a knife to his liking. As you can see, nothing changes in Russia, everything remains at the level of Saltykov-Shchedrin’s famous definition “On the stupidity of Russian laws and the possibility of finding workarounds for their non-compliance.” What is possible without restrictions? Have a knife with a blade length of up to 90 mm, although for dagger-type blades this figure is 50 mm. The law formally does not contain such a restriction, but there is an unspoken opinion of certification bodies. However, there is nothing to be outraged about either: if a knife is needed for work, then one-sided or one-and-a-half sharpening is enough for you, if you consider the knife as a combat knife, then, excuse me, certify it as a weapon, no one bothers you. You can have a folding knife with any dimensions of the blade, provided there is no rigid fixation of the blade. Reason: with such a fastening of the blade, it is rather problematic to deliver a stabbing blow. It is allowed to have a folding knife of any design with a blade length of less than 90 mm, including a balisong and a knife with automatic opening.
