University of Alabama in Huntsville sued for allegedly violating state’s ‘Campus Free Speech Act’
Young Americans for Liberty, the nation’s leading youth libertarian organization, announced a free speech lawsuit against the University of Alabama in Huntsville Thursday aiming to strike down a policy that requires students to obtain speaking permits three days in advance of campus events.
The Alliance Defending Freedom, which is representing the school’s YAL chapter in the suit, is alleging that the policy violates Alabama’s Campus Free Speech Act.
“Alabama law is clear: Students don’t need a permit from college officials to speak on campus, but that’s exactly what the University of Alabama in Huntsville is doing — violating the law and shutting down speech on campus,” ADF counsel Michael Ross, who specializes in academic freedom, said in a statement. “Public universities are the very places that should be encouraging free speech, not stifling it with burdensome and illegal rules.”

The state law explicitly prohibits prior permission requirements for campus speech. And the U.S. Supreme Court has interpreted the First Amendment to prohibit “prior restraint” on speech as well.

A university spokeswoman said the school could not comment on the specifics of the pending litigation.
“The University of Alabama System Board of Trustees, the University of Alabama System, and the University of Alabama in Huntsville are steadfastly committed to the freedom of speech and expression for all campus community members,” she said. “Our policies were implemented to preserve this important constitutional right.”
On its website, the school’s policies for outdoor areas and use of facilities state that UAH aims to protect free speech within reason.
“UAH supports the right to free expression on campus by University affiliates, through rallies, speeches, petitions, vigils, and distribution of materials, among others, provided such an Event complies with this policy and does not disrupt normal University activities, infringe upon the rights of others, or otherwise infringe on UAH’s significant interests,” a portion its policy reads.
For planned outdoor events, campus groups are asked to seek a reservation between 10 and three days in advance. Requests to reserve space within campus facilities require applications even earlier – between 30 and 14 days prior.
And the policy requires written requests for the use of sound amplification and public address systems, which the school will consider “on a case-by-case basis.”
“Students cannot thrive when college administrators are actively stifling the First Amendment,” YAL chief of staff Sean Themea said in a statement. “The three-day approval period is nothing more than a way to silence anyone trying to express a new opinion on campus. To this end, YAL looks forward to teaming up, once again, with ADF to bring free speech to the University of Alabama in Huntsville.”

The school policy requests that protests over controversial guest speakers be civil and warns that people attempting to interfere with one are subject to removal from the premises.
“The ideas of different members of a campus community will often and quite naturally conflict, but it is not the proper role of UAH to shield or attempt to shield individuals from ideas and opinions they find unwelcome, disagreeable, or even deeply offensive,” the policy continues.
The school’s policy also defines “special guidelines for spontaneous activities of expression” – public speech in response to breaking news or current events. They are confined to 16 locations on the 432-acre campus.

The Research or Creative Experience for Undergraduates (RCEU) Program
Program Description
The purpose of The University of Alabama in Huntsville RCEU program is:
- To support research or creative work experiences for undergraduate students in all fields of study
- To foster cooperation between students and researchers in a research or creative endeavor, and to expose the student to academic scholarly work via active participation in a research, creative, or scholarly project
- To assist in furthering UAH’s research activities by helping to provide opportunities for new and ongoing areas of study and creative work
Students undertake activities within a research or creative work project typically lasting for 10 to 12 weeks in the summer and under the direct supervision of a UAH full-time faculty member or researcher (including tenure-earning and tenured faculty, lecturers, and research staff with term faculty appointments).
The work hours correspond to a full-time job (approx 32-40 hours per week) and will also include a stipend/allowance for living expenses. Housing will be available in University housing at the usual rates for summer occupancy.
To participate in the program, students must be enrolled as a UAH undergraduate student for either the summer or fall semester of 2017. While previous RCEU student participants can apply, preference will be given to new student applicants. Women and minority students will be encouraged to apply. Proposing faculty and researchers are requested to encourage female and minority student applicants.
A non-exclusive list of possible activities includes laboratory experiments, musical compositions, field studies, clinical projects, engineering experiments and projects, theoretical work, human behavior studies, writing projects, and visual art projects.
The program is funded through the office of the President, the office of the Provost, and the office of the Vice President for Research and Economic Development at UAH, as well as through the College of Science, the College of Business, the College of Nursing, and the Alabama Space Grant Consortium and other sources as they become available. The Faculty Senate Finance and Resources Committee reviews RCEU proposals and makes individual awards. The committee strives to provide an equitable distribution of awards between colleges and departments.

The International Student and Scholar Services is a committed advocate for The University of Alabama in Huntsville’s international community and provides a safe and confidential setting where individuals can receive assistance regarding their needs and concerns. Our primary responsibility is to assist F-1 students, UAH sponsored J students and scholars, and individuals sponsored by UAH for employment purposes with the processes required to be enrolled as a student or hired as an employee of UAH.
We recognize the importance of balancing responsibility to the institution; to international students, faculty, and scholars; and to the appropriate government agencies. To that end, we strive to be a liaison between UAH sponsored employees, researchers, and students and a highly complex government bureaucracy.
We ensure the university is SEVIS compliant and that F students and J students and scholars have appropriate information and guidance necessary to maintain their status in the U.

Competitive Scholarships are made available to students through the generosity of alumni and friends of the University. The UAH Scholarship Application is used to determine eligibility for all competitive scholarships. The priority deadline for submission of this application is December 15. Graduate Teaching/Research Assistantships
Graduate assistantships provide financial assistance to graduate students as they pursue a degree.
There are two kinds of assistantships: Graduate Teaching Assistantships (GTA) and Graduate Research Assistantships (GRA). GTAs share the faculty’s responsibility for teaching, whereas GRAs do research under the supervision of a faculty member. Graduate assistants must be registered for at least 9 semester hours of graduate credit courses in the Spring and Fall (6 hours in the Summer) in which they hold an appointment. In return, the university will pay for tuition and fees for up to 12 hours per semester.

- Limitations of Liability
- The Service is provided to the User on an “as is” basis.
- The Service Administration is not responsible for any errors, omissions, interruptions, deletions, data loss, defects, delays in data processing or transmission, communication line failures.
- The User undertakes not to transfer the login and password from the Service account to third parties.
- The Service Administration is not liable to the User or to any third parties for any losses, including lost profits and damage to honor, dignity or business reputation, caused in connection with the use of the Service.
- Exclusively for the purpose of executing this Agreement, the Service Administration may process the User’s personal data. Due to the fact that the processing of personal data is carried out by the Service Administration in order to fulfill this agreement, the User’s consent to the processing of his personal data is not required in accordance with the current legislation of the Russian Federation. - Final provisions
- In the event of a reorganization of the Service, the transfer of rights and obligations under this Agreement to another person is possible. The User is notified of such cases by a special notification on the Site.
- The Service has the right to amend this Agreement with mandatory notification, which will be available to the User on the Site.
- In all matters not regulated by this Agreement, the User and the Service are guided by the Privacy Policy, as well as by the current legislation of the Russian Federation.
- This Agreement is signed by the Service with an enhanced qualified electronic signature, which confirms the authenticity and reliability of the Agreement. - In the event of a dispute between the User and the Service in connection with this Agreement, both parties are obliged to strive to resolve such disputes through negotiations.If it is impossible to resolve the dispute through negotiations, the dispute may be referred to the court in accordance with the legislation of the Russian Federation, with the obligatory observance of the claim procedure. The claim is sent by the party intending to go to court to the other party in advance. The term for responding to a claim is 30 (Thirty) calendar days from the date of its receipt.

First of all
it concerns women, and there is hardly anything that can be done about it.The BBC Capital columnist explains why.
After being laid off at cable company Comcast, Chavonne Patrice Owens finally found a new job last year at a day care center in Huntsville, Alabama.
At least she thought so.
A friend put in a good word for her, and Owens was invited for an interview, and after that he was even introduced to the children and staff.
She then called the preschool several times, but no one answered her calls.
“I had kindergarten experience and qualifications for the position, but they told my friend they wouldn’t take me because I’m too big,” Owens says.
With a height of 183 cm, she weighs more than 227 kg. At the interview, she assured a potential employer that, despite her weight, she can easily sit on the floor and communicate with children.
Obese people constantly face discrimination in the workplace, even if they are professionals in their field.
More and more countries (including the UK) are adopting laws prohibiting discrimination against workers on the basis of gender, age, race, nationality, sexual orientation, religion or disability.

Nevertheless, many companies see nothing wrong with to refuse or fire an overweight person.
“Obesity is certainly one of the few socially condemned parameters that we still consider acceptable to be discriminated against,” says Enrika Ruggs, assistant professor of psychology at the University of North Carolina at Charlotte.
“I wonder why this prejudice is so widespread when you consider how many people in the US are overweight,” she adds.
Draw Boundary
It is generally believed that a person with a body mass index (BMI) greater than 30 is obese, and a person with a BMI greater than 40 is morbidly obese.
(To calculate the BMI, you need to divide the weight of a person in kilograms by his height in meters squared.
The norm is BMI from 18.5 to 24.9).
Employers often underestimate the ability of obese people and believe that they will not be able to cope with difficult tasks or work long hours without getting tired. In fact, overweight people can be very strong and resilient.
“Each person’s abilities need to be assessed individually and not think that all big people are equally bad when it comes to physical labor,” says Abigail Saghai, professor of sociology at the University of California, Los Angeles and author of “What’s Wrong with fat. “
“A large person can be in very good physical shape; for some people obesity does not interfere with running marathons,” she adds.
To determine whether obese men face discrimination when hiring a salesperson and when shopping in a store, Ruggs conducted her own investigation.

Normal weight men visited several stores in their usual form and then went to other stores but already wearing fake bellies.
Ruggs found that men who seemed overweight faced “interpersonal discrimination”, that is, with a lighter form of bias.
The salespeople who served them smiled less, looked them in the eyes less, stood farther from them, and tried to end the conversation faster than normal-weight men.
Women are even worse
According to some studies, obese women suffer from discrimination more than obese men.Scientists from the University of Exeter have shown that overweight women have worse life prospects and earn less.
They examined 70 genetic variants associated with body mass index using data provided by the UK Biobank on 120,000 people between 40 and 70 years old.

“The genetic variation that makes a woman a little fat makes her a little poorer,” says Tim Freiling, professor of human genetics.

According to the study, if a woman weighed 6.3 kg more for purely genetic reasons, her annual income was $ 1,867 less than a woman of the same height, but with less weight.
Overweight women are more likely than women of normal weight to work in areas that involve physical labor – providing health care at home, preparing food and caring for children. In addition, they are less likely to occupy positions involving interaction with people.
This is evidenced by the results of a study by Jennifer Bennett Shinall, assistant professor of law at Vanderbilt University in Nashville, Tennessee.
Moreover, she found a wage gap between overweight and normal weight women.
This is partly due to the fact that manual work is often less paid than client work.
However, Shinal also found that even if a fat woman works with clients, she still receives less than other women.
“There is a lot of society’s focus on how women look, so preference discrimination might be one possible explanation,” says Shinal.
“Employers may feel that their clients find obesity in women more repulsive than men and are reluctant to hire overweight women to serve clients,” she explains.
Call for Change
The Obesity Action Coalition, based in Tampa, Florida, has developed a guide for employers around the world that talks about and how to deal with prejudice against obese people.
For example, it calls on employers to include fat people in an equal rights program, to include measures to combat bullying fat people in the workplace, and to organize so-called sensitivity training for recruiters.
David Brittman, who has been overweight for most of his life, recalls one diversity training a law firm organized for its employees. It was hosted by Korean and African American women.
They talked about gender, racial, ethnic and religious discrimination, and when Brittman informed them that they were missing out on a whole group of people – those who are overweight – they just laughed and said that they did not think that these employees were exposed to discrimination.
Brittman is now retired. He says his directness saved him from insults. “I didn’t sit timidly in the corner and complain about my fate, as many fat people do,” he says.

But he could not completely avoid bantering. When he was a manager at a dental college filing center, a colleague said that “everyone’s going to have to make room for David to get in the elevator.”
He reported this incident to the HR department, but was told that such actions are not punishable. (Brittman’s maximum weight was 209 kg, and now he weighs about 125 kg.)
Setting legal precedent
If obesity is not legally recognized as a disability, an employee is usually legally unprotected. In the United States, weight discrimination is legally prohibited only in Michigan and in some cities.
The American Equal Employment Opportunity Commission (EEOC) has filed lawsuits against employers, citing federal legislation prohibiting discrimination against people with disabilities, but has not achieved much success so far.
“The challenges in enforcing this legislation are because in many cases obesity is not disabling,” says Rebecca Poole, associate director of the Center for Healthy Nutrition and Obesity at the University of Connecticut.
“Therefore, the laws to protect the rights of people with disabilities do not apply to all cases of weight discrimination,” she explains.
Most often, the court refuses to accept arguments related to incapacity for work.Earlier this year, a US federal court of appeals ruled that obesity was not a ground for disability and upheld the lower court’s decision that there was no basis for discrimination against BNSF Railway.
The plaintiff filed a lawsuit against her because he was not hired after learning that his BMI is above 40, which does not meet the company’s high safety requirements.
In this case, the appellate court ruled that in order to be considered a physical handicap under the disability law, obesity must be the result of a physiological disorder or condition.

However, in 2012, the EEOC still won a $ 125,000 lawsuit against a drug treatment center that fired an employee allegedly for being overweight.

In this case, a US federal court ruled that severe obesity can be considered a disability, regardless of whether it was caused physiological disorder or not.
“If the court decides that morbid obesity is a disability, the employer will have to prove that the person who was refused employment was unable to work or was threatened because of his obesity,” says Christopher Kuchinski, assistant legal counsel at EEOC.
The European Court of Justice has also ruled that obese employees are only entitled to protection if being overweight is the reason for the disability.
This decision was made at the suit of a child educator from Denmark, who was dismissed by the local administration from a position he had held for more than 14 years.
“He performed his duties satisfactorily, but his obesity placed certain restrictions on his work. For example, it was difficult for him to sit on the floor and get up while playing with the children, and he could not run and walk as fast as they did”, – says Jacob Sand, the plaintiff’s lawyer (the case is now on appeal to the Danish High Court).
Since obesity in women is more detrimental to their employment than men, Shinall, an assistant professor at Vanderbilt University, believes the government should take action against employers who violate sex discrimination laws.
For example, in the early 1990s, the EEOC won several gender discrimination lawsuits against American airlines that imposed certain weight requirements for flight attendants.
Avoiding offensive words
Some people have developed their own strategies to combat weight discrimination or just jokes about excess weight in the workplace.
Walinda Royal was once fired from a dental clinic because the new dentist “didn’t like” her weight and the fact that she works with patients.
Royal filed a complaint and the clinic ended up paying her about $ 1,000.
“I have heard more than once that I’m more stupid than others because I’m fat,” she recalls. “But many years ago, I learned not to take insults about my weight and discrimination too painful.”
“What matters is how you feel about these things; you don’t have to feel inferior to what others think of you,” she says.
Over time, thanks to the support of her family, she was able to develop high self-esteem.
