In the case when children are taken into custody by different persons, or when one of the children remains in a residential institution, and his brothers / sisters are taken into care, the children retain family rights in relation to each other. One of these rights is the right to communicate with each other.
Article 55 of the Family Code of the Russian Federation. “The right of the child to communicate with parents and other relatives” establishes
– “1.
The child has the right to communicate with both parents, grandparents, brothers, sisters and other relatives.” And in case of separation of children, each of them has the right to demand that they ensure communication with other relatives, brothers and sisters. This is established by paragraph 5 of Article 148.1 of the Family Code of the Russian Federation
– “5. A guardian or custodian shall not have the right to prevent the child from communicating with his parents and other relatives, except in cases where such communication is not in the interests of the child.
Adoption is a completely different matter. Article 137 of the Family Code of the Russian Federation “Legal consequences of the adoption of a child” establishes
– “1. Adopted children and their offspring in relation to adoptive parents and their relatives, and adoptive parents and their relatives in relation to adopted children and their offspring are equated in personal non-property and property rights and obligations to relatives by origin.
2. Adopted children lose their personal non-property and property rights and are released from obligations towards their parents (their relatives)”.
Therefore, brothers and sisters of an adopted person, if they were not adopted into the same family, legally become strangers to each other and lose the right to communicate, receive information about brothers and sisters.
In addition, the law prohibits persons and bodies aware of the adoption – guardianship authorities, administration and employees of children’s organizations, registry offices, courts, etc. give out any information about the new name, patronymic and place of residence of the adopted child, his adoptive parents. Therefore, it is illegal to request and demand any information from them.
In order to understand what can be done and how in such a situation, it is necessary to understand what procedure for obtaining information and establishing contact and, possibly, further communication will not violate the requirements of the law and who makes decisions about the possibility of contacts.
Since the adoptive parents become the new parents of the child and his legal representatives, only they determine whether it is in the interests of the child to communicate with former relatives, but already legally strangers to him. Neither the guardianship authorities nor the court can demand from them to ensure communication. This means that their will and consent to communication is required.
Unfortunately, in Russia there exists, as a legal and mental relic, the secret of adoption. Many Russian adoptive parents are still of the opinion that it is better that no one knows anything, including the adopted child. Of course, with such an attitude, they in every possible way avoid any communication and exchange of information between children, even through intermediaries. Foreign adoptive parents, on the contrary, overwhelmingly believe that such a secret is harmful, try not to tear the child away from their roots and are keenly interested in any information. Recently, in Russia, the attitude towards the secrecy of adoption is also gradually changing, and more and more adoptive parents are interested in the possibility of communication between blood brothers and sisters and the exchange of information between them.
More than that, it is often useful to the adoptive parents themselves.
What and for what purpose are adoptive parents interested in when they agree to the exchange of information and communication of the child with blood relatives? Most often this is the following information:
– Who were the parents of the child and why did it happen that the child was left without parental care. Of course, the adoptive parents have access to all the documents available in the child’s case, but they are interested in some of the nuances that may not be reflected in the case.
– What did the child’s parents look like in their youth or childhood, what habits or character traits did they have.
– Who and what were the child’s progenitors, what ethnic group they belonged to, what they were interesting for, what achievements they had, where they came from. Such information helps to find the roots of the child’s origin, the positive qualities that the child could be proud of, to understand what happened in the family when something went “wrong”.
– The most varied information of a medical nature: what hereditary diseases were in the family, what the parents were ill with, how the mother gave birth, what diseases and why the child was ill before entering the family.
– Does the child have brothers, sisters, including half sisters, where are they, why.
– Many will be happy to see photos of the house where the child lived, the place where the parents come from, photos of brothers, sisters and other relatives. Both adoptive parents and adoptees show the greatest interest in photographs of the child in his former family or institution and parents in childhood and youth.
So, the only working way to establish contact with adoptive parents is to try to contact them and convince them that such communication can be useful to them and, of course, safe. Since it will not be possible to directly send them an invitation to communicate, you need to apply with such a request to the guardianship authorities, since other organizations (court, registry office, child care institution), although they have information about the adoptive parents, do not maintain contact with them and do not have the authority to or proactively intrude into their privacy.
The guardianship authorities, for at least three years, are obliged to carry out checks on the living conditions of the child and regularly interact with his adoptive parents. If the adoptive parents are foreign citizens, then such checks are carried out by the adoption agency in the country where the child lives, and sends the report to the guardianship and guardianship authority at the place of adoption, which means that the guardianship authority should have contacts with the agency.
Technologically, the process of sending an invitation to communicate looks like this:
1. You will need to purchase two envelopes. One large for domestic shipments, the second smaller for international 1st class shipments. It is desirable that the second envelope normally fit into the first envelope with all its contents (letter and photographs).
2. Write a letter to the adoptive parents, explaining the purpose of the appeal, how communication can be useful for them and the child, what exactly and in what form you want to receive from the adoptive parents, how you intend to communicate.
Be sure to include all your possible contact information. It is very important that the letter does not contain threats, demands or hints that you intend to get something from someone – otherwise it will immediately be thrown into the trash.
You need to write in a clear and simple language, in short phrases and without the use of abbreviations, slang, parochial expressions, and also, it is important to try not to make grammatical errors. The translator to whom the adoptive parents will contact must be able to convey to them the meaning of your request without distortion. It is optimal to translate the letter into the intended language of the adoptive parents, or at least into the language of international communication – English. 3. Prepare and attach the most interesting photos. You don’t need a lot, two or three is enough to start.
It is important that it is clear what is depicted on them and there is a signature on the back indicating the depicted place and time of fixing the event.
4. Enclose the letter, its translation and photographs in a small envelope. Leave the field for the address “to whom, where” free – it will be filled in by the guardianship authorities, indicate your return address. It is best to write your (return) address in English. Do not seal the envelope so that the guardianship authorities can make sure that your request and the attached materials do not contain anything that could then create a problem situation for them.
5. Prepare a letter to the guardianship agency that handled the adoption of the child, asking them to forward your letter in a small envelope directly to the adoptive parents or to the agency that handled the adoption of your brother or sister. The main thing is to try to convince the guardianship authority to send your letter to the adoptive parents and this will not create further problems for either the adoptive parents or the guardianship authorities.
Try to justify your request in the interests of the child and the adoptive parents. 6. Put the letter to the guardianship authorities and the small envelope into the large envelope. Indicate in the field “To whom, where” the address of the guardianship authorities that carried out the adoption.
