Music fans responded with disbelief this week to the release on streaming and social media platforms of the viral song “Heart on My Sleeve.
”
The hosts of the popular music-related YouTube channel LawTWINZ were among the many who weighed in, discussing whether the track, which uses artificial intelligence to simulate the music of pop stars Drake and The Weeknd, even surpasses the real pop stars’ talents.

Advances in AI have gotten to the point where the technology can quickly create new songs like “Heart on My Sleeve” that sound like they’re the work of real artists.
Recent examples, which include a faux song that sounds a lot like something the British alt-rock band Oasis would put out, hint at AI’s bold, creative possibilities and its ethical and legal limitations.
Now, artists, lawyers and other industry players are trying to figure out how the technology can be used responsibly.
‘The cat is not going back in the bag’
The popularity and revenue-earning potential of AI-generated songs have understandably put music industry gatekeepers on guard.
Drake and The Weeknd label owner Universal Music Group invoked copyright violation to get the platforms to take “Heart on My Sleeve” down this week.
“The training of generative AI using our artists’ music (which represents both a breach of our agreements and a violation of copyright law) as well as the availability of infringing content created with generative AI on DSPs [Demand Side Platforms], begs the question as to which side of history all stakeholders in the music ecosystem want to be on: the side of artists, fans and human creative expression, or on the side of deep fakes, fraud and denying artists their due compensation,” said the company in a statement shared with NPR.
This wasn’t the first time the music corporation flexed its litigation muscles, and it won’t be the last; earlier this month, it ordered a takedown of an AI track based on the music of Eminem. The song featured lyrics like, “Cats, cats, cats, always on the prowl / They’re sneaky and sly with their eyes on the goal.
”
“The cat is not going back in the bag,” said Stanford University associate professor Ge Wang, of the growing popularity of AI-generated music online. Wang, who teaches a class on AI and music, said as the technology becomes more widespread, people can no longer afford to think of it as the stuff of science fiction.
“There’s something that we couldn’t do now that we can,” Wang said. “And along with it is a ton of legal, ethical and artistic considerations that we didn’t have to think about before in a practical sense. But now we do.”
Music/AI litigation in its infancy
Now, the music industry is trying to play catch up.
From a legal standpoint, music and AI litigation is in its infancy. “It’s an emerging area,” said entertainment lawyer Craig Averill. “The courts have not weighed in.”
The U.S. Copyright Office has issued decisions around AI-related works.
“The author has to be a human as the law stands,” Averill said. “It can’t be completely computer-generated.
“
But Averill said dizzying questions remain about the amount of human intervention needed to make AI-generated musical works copyrightable. And if the face of the work isn’t a human, then who’s the copyright holder?
“If you come up with a composition and then you have an animated character that’s front-facing for it, and you don’t have to really pay that entity any royalties, what does that look like?” Averill said. “We’re not there yet.”
Ethical and aesthetic issues abound
Some artists are skeptical that the law will ever catch up with the technology, given the speed at which it is developing.
“It’s completely broken logic that legislation or litigation is going to protect the arts,” said Grammy-nominated electronic musician and software developer BT. “It’s not gonna happen. It [the technology] is evolving too quickly.”
BT said artists — rather than lawyers — should create guardrails around how AI is used for music production and sharing. Like all of the musicians interviewed for this story, BT said he sees great potential in AI as a resource — as long as artists are paid properly.
And he also said there are enormous ethical issues to contend with.
One example is when an AI tool generates lyrics in an artist’s style that the actual artist would never sing. The unlikely Eminem song about cats is a case in point — albeit a relatively harmless one. The technology could create lyrics that are much more controversial and potentially damaging to a singer’s reputation.
“Where we’re talking about the creation of vocals, it could be used to say something that is polar opposite to that person’s belief system,” BT said.
Then there’s the question of aesthetics.
“One danger is the lowering of artistic standards to a point where fake becomes real and mediocrity rules,” said singer-songwriter and voice actor Dan Navarro. “Then commercial music becomes like brown-food-product; able to sustain life, but never truly satisfy.”

Drake’s AI clone is here – and Drake himself may not be able to stop him

Major record companies are pursuing songs created by artificial intelligence, claiming they infringe copyright. Lawyers say the approach is far from simple.
A certain type of music has been inevitable on TikTok in recent weeks: clips of famous musicians performing songs by other artists, with combinations that read like someone has pressed a randomizer button. There, Drake covers singer-songwriter Colby Kailat, Michael Jackson covers The Weeknd, and Pop Smoke covers Ice Spice’s “In Ha Mood”. In fact, the artists do not perform songs – they are all generated using artificial intelligence tools.
And the resulting videos gained tens of millions of views.
For Florida college student Jared Chavez, the end of March saw the leap from fiddling with AI tools overnight to becoming a viral hit. He posted a video of Drake, Kendrick Lamar and Ye (formerly Kanye West) singing “Fukashigi no Karte”, the theme song from the anime series. Since then, it has collected more than 12 million views in a month.
Since then, Chavez has been creating new clips at a steady rate, getting millions of views on dozens of videos, launching versions of songs, and a cappella with the help of AI models trained to sound like the most recognizable musicians in the world. TikTok loves them and they are cheap, fast and easy to make.
“I was very surprised [at] how easy it was. Straight out of AI, this sounds pretty good. Sounds real,” Chavez says of the process. “Honestly, it’s a little scary how easy these things are to do.”
So far, the platforms have not removed Chavez’s video, but threats may appear in the near future – if major artists and labels figure out how to stop him.
Influencers in the music industry are already getting other AI-generated music from streaming services, citing copyright infringement. But this argument is far from unambiguous, lawyers say. There is no precedent for the real Drake being able to stop the robot Drake on the grounds of copyright, yet copyright has once again become the most effective way to rip something off the internet that someone doesn’t like.
“In such circumstances, it’s easy to use copyright as a bludgeon to go after new creative content that you think crosses some line, even if you don’t have a really strong legal basis for doing so, because of how strong the copyright system is. the law is,” says Nick Garcia, a political adviser to Public Knowledge.
Such is the case with arguably the most notable song created by artificial intelligence, “Heart on My Sleeve,” which went viral earlier this month thanks to its rather convincing pantomime of Drake and The Weeknd. The song, posted by an anonymous TikToker user Ghostwriter, racked up millions of streams before being taken down by Spotify, Apple Music, TikTok and YouTube.
In the case of YouTube, the culprit for the deletion was what appeared to be an unforced error: otherwise, the original song inexplicably contained the Metro Boomin production tag at the beginning. Universal Music Group stated that it was an unauthorized sample and successfully withdrew the song. In this case, the copyright claim worked, but hardly. Other original songs such as AI Drake’s “Winter’s Cold” have also been removed from streaming platforms due to alleged copyright infringement.
“Heart on my sleeve” is exactly what UMG wants streaming platforms to crack down on, saying AI companies are violating copyright law by teaching their models songs from artists (both Drake and The Weeknd have contracts with UMG ). The same argument is being made in other creative industries: Getty Images, for example, is suing the creators of art generator Stable Diffusion, alleging that Stability AI “illegally copied and processed millions of copyrighted images” when it trained its AI system .
Online publishers are also following this path, stating that they should be compensated for their content that is used to train chatbots.
The problem with the removal of songs like “Heart on My Sleeve” and “Winter’s Cold” is that these tracks don’t copy anything specifically protected by law. Both songs appear to be written by a human, not Drake, and are loaded into voice cloning software, so the songs are new, original pieces. An artist’s voice, style, or delivery is not copyrighted (for the most part). If an up-and-coming artist wrote their own lyrics, did a simple beat, recorded the vocals, and ran them through The Weeknd’s machine, none of the existing work is copied. Promoting the new track as a The Weeknd song would be risky, but it would be closer to a trademark issue than copyright.
Advances in artificial intelligence voice technology currently being used also make the sampling problem more difficult. Unlike older technologies that cut and rearrange pre-existing recordings, many artificial intelligence systems create new sounds that resemble the target voice.
According to Garcia, even if tiny bits of the recording were somewhere in the new song, they would probably be so small that they could not rise to the level of copyright infringement.
Big issues in the art industry tend to be filtered through the prism of copyright because the law can act like “a very big hammer that can hammer many, many nails,” says Meredith Rose, senior policy adviser at Public Knowledge. The argument that AI Drake’s song infringes on the real Drake’s copyright is not unambiguous, but it has become the main way that labels – and therefore the public – contemplate potential problems with AI songs.
Copyright is a concern, but it’s largely a side issue, tied to some bigger, more existential questions about economic displacement, flipping business models, and deep fakes.

What if the creator made Drake’s AI sing the white nationalist anthem? The issue quickly escalates beyond copyright and affects Drake’s identity and personality – and, unlike the wave of AI unknowns, there is some precedent for how human likeness is used.
A person’s right to publicity allows him to control how his name or image is used to make money. But even before diving into how AI tools change things, there are major differences in how humans operate. Modern copyright law is at the federal level, and as part of that, DMCA removal offers a relatively quick and easy way to get the material without involving a lawyer or filing a lawsuit. The right to publicity (which, oddly enough, is also sometimes called the right to privacy) is more complex and exists only at the state level.
Only a few states have such a law on the books, but, importantly, California and New York — the two with the largest entertainment industries — have them. After all, people love to poke fun at celebrity images almost as much as celebrities hate to be pranked on. Many of the AI clone songs are sold as the AI ”Drake” or “Kanye West” tracks, but Garcia says their right of publicity can be extended even if the creator doesn’t explicitly name them in the ad. After all, listeners will probably recognize this voice singing “Paparazzi” with or without a picture of Ariana Grande to guide them. It makes sense that musicians known for their voices are the first test cases of advanced voice cloning technology. It raises a lot of questions about art, fair use, celebrity and pop culture — and as complex as these questions are, at least some version of that debate has been going on for decades.
