U.S. Department of Labor Resolves Pay Discrimination Investigation At Universal Protection Service Facility in Riverside, California
RIVERSIDE, CA – The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has reached a settlement with Universal Protection Service LP – a federal contractor – to resolve allegations of pay discrimination at the company’s Riverside, California, facility formerly owned and operated by Allied Barton Security Services.
During a routine compliance evaluation, OFCCP found discriminatory job placement and pay practices by Allied Barton Security Services – from January 1, 2014 through December 31, 2015 – which adversely affected African American employees in its site supervisor positions. Under the terms of the agreement, Universal Protection Service LP agreed to pay $51,351 to 14 class members. OFCCP determined the company’s practices violated Executive Order 11246, which prohibits federal contractors from discriminating in employment based on race, national origin, or gender.
“Federal contractors must ensure that their employment practices do not discriminate,” said Regional Director Jane Suhr, in San Francisco.
Universal Protection Service holds numerous security and technology-based contracts with federal government agencies, departments, and institutions.
In addition to Executive Order 11246, OFCCP enforces Section 503 of the Rehabilitation Act of 1973 and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974. These laws, as amended, make it illegal for contractors and subcontractors doing business with the federal government to discriminate in employment because of race, color, religion, sex, sexual orientation, gender identity, national origin, disability, or status as a protected veteran. In addition, contractors and subcontractors are prohibited from discriminating against applicants or employees because they have inquired about, discussed, or disclosed their compensation or the compensation of others subject to certain limitations. For more information, please call OFCCP’s toll-free helpline at 800-397-6251 or visit https://www.dol.gov/ofccp/.

- The first line is all the divisions of the bank that develop business processes and perform operations, including various control procedures (reconciliation, verification, self-control, etc.)etc.).
- The second is risk management and divisions responsible for managing the selected types of risk (legal department, security department, and others). Their mission is to provide support in risk management issues.
- The third is internal audit, the purpose of which is to independently assess the effectiveness of the built-in control and management system.
Reliable partners
The concept of risk partnership appeared in our bank relatively recently.Previously, specialists in operational risks could be called universal, which, on the one hand, made it possible to solve the necessary tasks, but on the other hand, there was no necessary focus and sufficient level of competence for detailed and in-depth study of issues.
Each risk partner interacts with the bank’s divisions in certain areas of activity. Possessing practical experience and knowledge in a specific area, they are the link between the bank’s divisions and risks.Today, employees of four major areas – retail and corporate business, information security and information technology – actively interact with risk partners and resolve those issues that require risk expertise. In other areas (for example, for the investment banking business), there is an active selection of candidates.
Transparent Methodology and Reporting
The financial industry is on the cusp of major operational risk management reforms. The Bank of Russia is preparing a document establishing new requirements that have never been previously imposed by the regulator. These changes will require not only the refinement of risk management methods and processes in terms of their identification, assessment and accounting, but also the introduction of an automated system that meets these requirements. To solve this problem, a separate project is opened.
As part of the implementation of the new requirements for the operational risk management system, the concept of key indicators has already been approved, which will allow monitoring the level of risk and promptly reacting to possible deviations.
The current reporting is being revised and new reporting is being introduced, and very soon the bank’s management and interested teams will be able to receive objective information in an updated and convenient format. Work is underway to create a register of processes and their owners, measures are being taken to secure the responsibility of departments and employees of the bank for the quality of risk management. The relevant requirements are planned to be reflected in key performance indicators.
The implementation of these requirements will significantly increase the bank’s capital adequacy.
Comprehensive insurance
Insurance is one of the ways to minimize operational risk. It can be used both in relation to specific banking risks, for example, comprehensive banking insurance, and in relation to certain types of risks, such as: liability of directors, officials and companies, as well as crimes in the computer sphere, etc. All this allows you to make optimal decisions regarding the perimeter and amount of risk, expanding insurance coverage in a timely manner, or make proposals to reduce individual risks.
Business Continuity
One of the key management tasks is to ensure the continuity and restoration of the bank’s activities (O&VD). The function is being developed taking into account the best market practices and industry standards.
The institution of C&VD coordinators has been formed, approaches have been identified to identify critical business processes. The categorization results are already being used to improve the reliability of customer services.
Plans for 2020 include conducting large-scale exercises within certain scenarios. This practice meets high international standards, although it is rarely found in Russian banks.
To achieve this goal, the teams-
yes formulates the plan of exercises and oversees preparatory work: pilot tests were carried out for a number of business and support units, including the depository, treasury, and individual employees of the business operational support department. Further testing is planned at the parent organization.
Committee
The members of the Committee for Management of Operational and Regulatory (Compliance) Risks (CERRR) are representatives of all GBLs and most of the Bank’s GFLs.
The Committee considers the risks arising in connection with the development of new and development of current products, changes in legislation, and optimization of the bank’s internal processes.
Since the beginning of 2019, a lot of work has been done to reform the activities of the committee, several compositions of participants have been created, each of which considers a certain range of issues. The updated format allows you to focus on specific types of losses and critical issues. The functional team of the committee closely interacts not only at the stage of preparation of materials, but also monitors the risks assumed.
It is often the case that significant operational or regulatory risks are identified in the process of considering a new product. Then the question is brought up to the KUORR to discuss the possibility of their adoption or the need to develop measures to minimize them.
Risk management culture at VTB
Elena Morozova,
Head of Operational Risk Department:
To what extent are your colleagues generally savvy in this professional field? These are open questions that we ourselves must answer. As a team, we have a lot to do to explain and train each bank employee how important operational risk management is in the activities of our credit institution. What tools are used to identify, monitor and assess risks? What to do in situations if an operational risk event has occurred?
And one more question that we ask ourselves – do the heads of divisions support our initiatives? Is the timely communication of information to risk management encouraged or is data on operational risk incidents not escalated in a timely manner, which means it does not contribute to making correct management decisions and, in general, does not increase the efficiency of the bank’s risk management? To accomplish this task, we are developing measures and training activities for bank employees. At the same time, our risk partners are the main source of information for business and P&C. They are the face of our team. ”

Kaspersky Lab patented protection against BadUSB
Perhaps the worst nightmare of any user is when an invisible virus infects the very hardware of the computer, not the operating system. Unfortunately, this is not fiction at all – the vulnerabilities that allow you to do this do exist. One of them was discovered a couple of years ago in the USB interface, the researchers called it BadUSB.
This is how it works: with the help of not the most complex manipulations, you can change the firmware of a USB device so that malware will settle in it, in the firmware, which, among other things, will allow the device to pretend to be something completely different.
For example, an ordinary flash drive after such a flashing can learn to pretend to be a USB keyboard – and enter commands on behalf of the user. For example, at a certain moment, you can order to erase all your files – or give any other command. The same flash drive can pretend to be a network card – and “listen” to the data stream going through the computer.
The problem is that such malware is contained in the controller of the flash drive, it is not visible from the outside. Therefore, ordinary antiviruses that scan files will not help here – after all, there are no malicious files on the flash drive, the virus sits much deeper. The second problem is that it is also impossible to take and fix the peculiarities of the operation of USB devices on which this attack is based.
Memory, USB, BIOS and other places of modern computers, the vulnerability of which is worth knowing: http://t.co/gSHxjVdWaX pic.twitter.com/wlUKGwtuez
– Kaspersky Lab (@Kaspersky_ru) March 30, 2015
However, Kaspersky Lab specialists Oleg Zaitsev, Olga Domke, Konstantin Manurin and Mikhail Levinsky have found a way to cope with this scourge. The technology they developed allows you to automatically monitor what is happening with USB devices in the system, detect abnormal behavior – and block devices if they try to do something suspicious.
This technology has already been implemented in our corporate product Kaspersky Endpoint Security, and recently the development team received a US patent for it.
“Despite the fact that attacks using modified USB devices are still considered theoretical, they are already arousing the interest of the company’s customers in appropriate security solutions – no one wants to be unarmed in the transition from theory to practice,” says Olga Domke.“By combining the efforts of the product and component teams, we developed the BadUSB attack protection component for Kaspersky Endpoint Security for Windows, in which, like any solution for a corporate environment, we tried to strike a balance between the convenience of the end user and the peace of mind of the administrator.”
