1. Municipal service provider , is the administration of the city of Irkutsk. 8) Documents issued by the bodies responsible for the registration of transport means confirming the presence (absence) of the vehicle in property of the applicant or his family members.

The authorized body, within 1 working day from the date of receipt of an application from a citizen for the provision of a land plot, notifies the local government. The local self-government body, within 1 working day from the date of receipt of this notification, sends to the authorized body an extract from the register of citizens and copies of documents on the basis of which the citizen was registered.
Citizens have the right to refuse the proposed land plot from among the land plots included in the list.If a citizen has refused the proposed land plot (including not applying within 3 working days from the date of delivery of a notification for the provision of a land plot to the authorized body), this land plot is offered to other citizens in accordance with the requirements established by Article 5 of the Law. At the same time, a citizen who refused the proposed land plot retains the right to receive a land plot in accordance with the Law.
If a citizen has not received a notification sent to the address indicated by the citizen in the application for registration, he retains the right to choose the proposed land plot until he refuses such a land plot.Until such a refusal, another land plot is not offered to this citizen.
Families whose member (members) has been awarded (awarded) in accordance with federal legislation with the Order of Parental Glory, land plots are provided on the basis of their application without taking into account the requirements established by paragraph 2 of Article 3 (excluding requirements for the need for residential premises), Article 4 (without registration as persons entitled to provide land plots in ownership free of charge), paragraphs 3-10 of Article 5 of the Law (without taking into account the provisions establishing the procedure for the provision of land plots to citizens registered, but taking into account the norms on the provision of land plots located within the boundaries of the urban district at the place of residence of the citizen, or in the municipal area bordering the city district at the place of residence of the citizen.
Citizens registered, whose right to receive a land plot was not realized due to the child (children) reaching the age of 18 years (23 years old, in the case of education of the child (children) in educational institutions, professional educational organizations, educational institutions of higher full-time education), persons specified in subparagraph 3 of paragraph 1 of Article 3 of the Law – 25 years old, retain the right to receive a land plot in accordance with the Law.
Article 8 of the Law establishes that the provision of land plots to citizens registered on the grounds and in accordance with the procedure established by regional legislation before the entry into force of the Law, whose right to receive a land plot has not been realized, is carried out in accordance with the Law on the basis of priority, determined when registering with the specified account.

With the advent of private ownership of the means of production, a confusion of concepts occurred, and lease became possible both between legal entities and between individuals.
The housing system turned out to be more inert and retained the division according to the characteristics of the subject composition. So:
- housing lease agreements are concluded by legal entities renting living quarters for their employees;
- a social rental agreement is concluded between citizens and the state (or municipal) housing stock;
- A commercial tenancy agreement is concluded between an individual – the owner of the home and the tenant – an individual.

So, we can distinguish some differences in the subject composition, as we talked about above, in the term of the contract and in the terms of registration.
“Living quarters” is too general a concept to be given a uniform definition. Common to all living quarters is the sign of its suitability and purpose for housing. Designation is understood as the state assessment of the building as residential. That is, a premise that has a non-residential status (storage rooms, workshops, offices, etc.) cannot be rented out for housing.etc.).
The second sign of the definition of housing as suitable for renting is its livability. Let’s say right away that the requirements for livability are determined depending on the norms of livability in force in a particular locality.

Essential conditions of the contract are the conditions on the subject of the contract, which are named in the law or other legal acts as essential or necessary for contracts of this type, as well as all those conditions regarding which, at the request of one of the parties, an agreement must be reached.
In the lease agreement for residential premises, an essential condition is the condition on the subject of the agreement. The lease agreement for residential premises must contain all the data that make it possible to definitely (unequivocally) establish the property that should be transferred to the tenant as a subject of lease. As mentioned earlier, the subject of a residential lease agreement may be an isolated residential area suitable for permanent residence (apartment, residential building, part of an apartment or residential building).The suitability of a dwelling for living is determined in the manner prescribed by housing legislation (clause 1 of article 673 of the Civil Code of the Russian Federation).
In the absence of data on the residential premises to be transferred to the tenant in the lease agreement for the dwelling, such an agreement shall be deemed not concluded.
Additional terms of the contract are the terms of the contract provided for in the relevant regulatory acts and automatically come into force at the time of the conclusion of the contract, which do not require the agreement of the parties.
Additional terms of the lease agreement for residential premises include:
- Obligation of the tenant to pay the rent on time. Unless otherwise provided by the contract, the employer is obliged to independently pay utility bills.
- The lease agreement for residential premises is concluded for a period not exceeding five years. If the term is not specified in the agreement, the agreement is considered to be concluded for five years.

- The current repair of the rented dwelling is the responsibility of the tenant, unless otherwise provided by the lease of the dwelling.

- The amount of payment for a dwelling is established by agreement of the parties in a lease of a dwelling.In the event that, in accordance with the law, the maximum amount of payment for residential premises is established, the payment established in the contract must not exceed this amount.
- The tenant, with the consent of the landlord, may transfer for a period part or all of the premises rented by him for the use of the sub-tenant. The tenant does not acquire an independent right to use the dwelling. The tenant remains liable to the lessor under the lease agreement.

In connection with the transition of the Republic of Crimea to the legal field of the Russian Federation, the procedure for providing free housing to citizens has changed significantly. In the Russian Federation, the rights of citizens guaranteed by the Constitution of the Russian Federation are subject to implementation in strict accordance with federal laws and laws of the constituent entities of the Federation. The circle of persons who enjoy the right to receive free housing is limited by law.
According to Article 57 of the Housing Code of the Russian Federation, residential premises under social tenancy agreements are provided to citizens registered as needing residential premises, in order of priority, based on the time of registration of such citizens.In addition, living quarters under social tenancy agreements are also provided to other categories of citizens as defined by federal law, by the Decree of the President of the Russian Federation or by the law of a constituent entity of the Russian Federation.
The procedure for registering those in need of residential premises is established by clause 2 of Art. 49 of the Housing Code of the Russian Federation, according to which residential premises under a social rental agreement are provided to citizens recognized in the prescribed manner as poor and in need of residential premises.
According to Article 52 of the RF LC, registration of citizens as needing residential premises for the purpose of subsequent provision of residential premises to them under social tenancy agreements is carried out by the local government on the basis of applications submitted by citizens at their place of residence.
To register those in need of better housing conditions, a citizen must be recognized as poor and be provided for one family member less than the accounting rate provided for by the legislation of the relevant constituent entity of the Russian Federation.
Residential premises provided under social tenancy agreements are formed:
– through the acquisition of residential premises into the ownership of a local government body;
– through the construction (reconstruction) of residential premises at the expense of the budget of the local government;
– at the expense of residential premises transferred to the ownership of the local government, in the manner prescribed by law;
– at the expense of vacated housing, which was previously provided under a social tenancy agreement.
Under a social tenancy agreement, residential premises must be provided:
1) citizens at their place of residence (within the boundaries of the respective settlement),
2) be suitable for permanent residence of citizens (i.e., meets the established sanitary and technical rules and norms, other legal requirements),
3) the total area for one person is not less than the provision rate.
Thus, citizens who are recognized as poor and other categories of citizens who have the right to receive housing in accordance with the legislation of the Russian Federation and the legislation of a constituent entity of the Russian Federation (regardless of the presence of a court decision on the provision of housing) are provided with free municipal housing in a single queue or out of turn, in the cases provided for in cl.2 tbsp. 57 LCD RF..
