Is the issuance of vouchers purchased by the organization to children’s camps for employees’ children subject to personal income tax and insurance contributions
Almost a hundred years ago, the first pioneer camps opened their doors to children. Since then, every summer, schoolchildren have been waiting for holidays in camps, which were located everywhere: from Moscow to the most remote corners of our homeland. For many of us, they have become happy childhood memories with pioneer bonfires, hikes, competitions and lightning. In no other country in the world organized children’s recreation was so affordable and did not receive such a scope. Undoubtedly, this was a huge achievement of Soviet social policy, which has not lost its relevance today.
Modern summer camps vaguely resemble their Soviet predecessors. They also teach friendship and mutual assistance, but their main focus is the improvement and all-round development of schoolchildren. At the same time, they can only be aimed at improving the health of children, or they can have programs aimed at developing children in certain areas: a sports camp, a creative camp, a foreign language camp, an Orthodox camp, etc.
Of course, the living conditions and technical equipment of modern camps differ for the better compared to the past. Thus, today, children’s camps, following the best Soviet traditions, offer holidays for schoolchildren for every taste and parental budget.
In our difficult time, there are practically no enterprises left that have children’s recreation centers on their balance sheets. However, our children still need rest and recovery. Fortunately, many employers pay great attention to the motivation of their employees. The main motivating package of any organization is social package , in which, in addition to the traditional – official (“white”) salary, various rewards for success, paid sick leave and medical insurance, many employers include elements of caring not only for the employees themselves, but also about the members of their families, and, first of all, about the children.
As part of the organization’s social policy, employers purchase vouchers to summer camps for the children of their employees, which are then issued to employees free of charge or for a portion of the cost of the voucher.
Will the issued vouchers be subject to personal income tax and insurance premiums?
No, the cost of such vouchers is not subject to personal income tax and insurance premiums.
Let’s see why. In accordance with paragraph 1 of Art. 209 of the Tax Code of the Russian Federation, the object of taxation for personal income tax is recognized as income received by individuals, both from sources in the Russian Federation and from sources located outside it.
When determining the tax base, income received both in cash and in kind is taken into account (Clause 1, Article 210 of the Tax Code of the Russian Federation). At the same time, in Art. 217 of the Tax Code of the Russian Federation lists income exempt from personal income tax. These include, among other things:
“the amount of full or partial compensation (payment) by employers to their employees and (or) members of their families for the cost of purchased vouchers, with the exception of tourist ones, on the basis of which these persons are provided with sanatorium and resort services and health-improving organizations located on the territory of the Russian Federation, as well as the amount of full or partial compensation (payment) for the cost of vouchers for children under the age of 16, on the basis of which services are provided to these persons by sanatorium-resort and health-improving organizations located on the territory of the Russian Federation, provided in including at the expense of organizations (individual entrepreneurs), if the costs of such compensation (payment) in accordance with the Tax Code of the Russian Federation are not included in the costs taken into account when determining the tax base for corporate income tax” (clause 9Art. 217 of the Tax Code of the Russian Federation).
The same position is shared by specialists of the tax department (letters of the Ministry of Finance of Russia dated 08.21.2019 No. 03-03-07 / 63999, dated 08.01.2017 No. 03-04-06 / 48824, Federal Tax Service of Russia dated 12.18.2012 No. ED- 4-3/21567, dated 05.12.2011 No. ED-3-3/4001).
I would like to draw your attention to the fact that the amount of compensation (payment) for the cost of vouchers for children under the age of 16, on the basis of which they will be provided with services by sanatorium-resort and health-improving organizations located on the territory of the Russian Federation, are exempt from personal income tax on the basis of clause 9 of Art. 217 of the Tax Code of the Russian Federation , regardless of the existence of labor relations between the organization making the specified payment (reimbursement) and the parents of the children (letter of the Ministry of Finance of Russia dated 06/28/2013 N 03-04-05 / 24690).
In order for the amount of the cost of the voucher not to be subject to personal income tax, enterprises providing the relevant services must be classified as sanatorium-resort or health-improving organizations (letters of the Ministry of Finance of Russia dated December 19, 2017 No. 03-04-06/32361).
Such organizations can be sanatoriums, sanatoriums, dispensaries, rest houses and recreation centers, boarding houses, health-improving complexes, sanatorium, health-improving and sports children’s camps (paragraph 6, clause 9, article 217 of the Tax Code of the Russian Federation).
The issue of classifying an organization as a sanatorium or health resort is entirely within the competence of the Ministry of Health and Social Development of Russia. Representatives of the financial and tax departments directly indicate this in their letters. The number of documents by which an organization can confirm that it is a sanatorium or health resort can include licenses, as well as constituent documents containing a link to its type of activity (letters of the Federal Tax Service of Russia dated August 11, 2014 No. PA-4-11 / 15746, the Ministry of Finance Russia dated February 21, 2012 No. 03-04-06 / 6-40).
In turn, the organization that bought the vouchers can confirm the validity of the exemption from personal income tax for the amounts paid for these vouchers to health resorts and health camps by submitting an agreement concluded with the listed organizations, as well as payment documents showing the intended purpose of the specified payment (letter of the Ministry of Finance of Russia dated September 19, 2014 N 03-04-06 / 46990).
As for the taxation of the cost of a voucher issued to an employee with insurance premiums, here, based on paragraph 1 of Art. 421 of the Tax Code of the Russian Federation, the basis for calculating insurance premiums is determined as the amount of payments and other remunerations provided for in paragraph 1 of Art. 420 of the Tax Code of the Russian Federation, accrued by payers of insurance premiums for the billing period in favor of individuals, with the exception of the amounts specified in Art. 422 of the Tax Code of the Russian Federation.
At the same time, payments and other remunerations made within the framework of labor and civil law relations are subject to insurance premiums (clause 1 clause 1 article 420 of the Tax Code of the Russian Federation, clause 1 article 20.1 of the Federal Law dated 07/24/1998 No. 125-FZ “On compulsory social insurance against accidents at work and occupational diseases” (hereinafter – Law N 125-FZ)).
At the same time, the law does not specify what kind of income should be attributed to income received in the framework of labor relations. So, in Art. 422 of the Tax Code of the Russian Federation (as well as Article 20.2 of Law No. 125-FZ) lists the amounts of payments that are not subject to insurance premiums. I must say right away that this list is exhaustive, and sanatorium and resort vouchers purchased for employees are not named in it.
Based on the foregoing, for a long time, specialists from the financial and tax departments took the position that obliges the employer to impose insurance premiums on the cost of vouchers for health resort treatment of employees. When purchasing vouchers for members of the families of its employees, the employer pays for individuals who are not in labor relations with him at all, in this case, unambiguously, the amount of payment for vouchers is not an object of taxation by insurance premiums (clause 1, article 420 of the Tax Code RF). Moreover, the conclusions of the judges do not contradict a number of explanations given by the Ministry of Finance and the Federal Tax Service in the relevant letters (letters from the Ministry of Finance of Russia dated September 20.2019 No. 03-03-06/1/72557, dated 04.30.2019 No. 03-04-05/32077, dated 04.23.2019 No. 03-15-06/29511, dated 01.24.2019 No. 03-03-06/ 1/3880, dated January 15, 2019, Federal Tax Service of Russia dated October 7, 2019 No. BS-4-11/20417, dated October 30, 2017 No. GD-4-11/22062).
As for the taxation of the cost of vouchers by insurance premiums against accidents and occupational diseases, they are also not subject to taxation (clause 1, article 20. 1 of Law No. 125-FZ).
Thus, when issuing vouchers to summer camps for the children of employees that were purchased by the organization, the object of personal income tax, insurance premiums, as well as contributions from accidents and occupational diseases does not arise.
